Villa Aneyakoji Terms and Conditions for Accommodation Contracts

Scope of Application
Article 1.
1.Contract for Accommodation and related agreements to be entered into between this accommodation and the Guest to be accommodated shall be subject to these Term and Conditions. Any particulars not provided for herein shall be governed by laws and regulations, and/or generally accepted practices.
2.In the case where the Accommodation has entered into a special contract with the Guest and insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the preceding Paragraph, the special contract shall take precedence over the provisions of these Terms and Conditions.

Application for Accommodation Contracts
Article 2.
1.A Guest who intends to make an application for an Accommodation Contract with the Accommodation shall notify the Accommodation of the following particulars:
1) Name of the Guest(s);
2) Date of accommodation and estimated time of arrival;
3) Accommodation Charges (in principle, based on the Basic Accommodation Charges listed in the Attached Appendix 1) ; and
4) Other particulars deemed necessary by the Accommodation.
2.In the case where the Guest requests, during his/her stay, an extension of the Accommodation beyond the date(s) in Item (2) of Article 2.1, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Conclusion of Accommodation Contracts, etc.
Article 3.
1.A Contract for Accommodation shall be deemed to have been concluded when the accommodation has duly accepted the application as stipulated in the Article 2. However, the same shall not apply when it has been proven that the accommodation has not accepted the application.
2.2. When a Contract for Accommodation has been concluded in accordance with the provisions of Item 3.1, the Guest is requested to pay an accommodation deposit fixed by the Accommodation within the limits of the Basic Accommodation Charges covering the Guest's entire period of stay (3 days deposit when the period of stay exceeds 3 days) by the date specified by the Accommodation.
3.3. The deposit shall be firstly used for the Total Accommodation Charges to be paid by the Guest, then secondly for the cancellation charges under Article 6 and thirdly for the reparation under Article 18 as applicable, and the remainder, if any, shall be refunded at the time of the payment of the Accommodation Charges as stated in Article 12.
4.When a Contract for Accommodation has been concluded in accordance with the provisions of Item 3.2, the Guest is requested to pay an accommodation deposit fixed by the Accommodation within the limits of the Basic Accommodation Charges covering the Guest's entire period of stay (3 days deposit when the period of stay exceeds 3 days) by the date specified by the Accommodation.

Special Contracts Requiring No Accommodation Deposit
Article 4.
1.Notwithstanding the provisions of Item 3.2 of Article 3, the Hotel may inter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Item.
2.In the case where the Accommodation has nor requested the payment of deposit as stipulated in Item 3.2 of Article 3 and/or has not specified the date of the payment of the deposit at the time the application for an Accommodation Contract has been accepted, the Accommodation shall be treated as having accepted a special contract prescribed in the preceding Item.

Refusal of Accommodation Contracts
Article 5.
1.The Accommodation shall have the right not to accept the application for an Accommodation Contract under any of the following cases:
(1) When the application for accommodation does not conform with the provisions of these Terms and Conditions;
(2) When the Accommodation is fully booked and no room is available:
(3) When the Guest seeking accommodation is deemed liable to conduct him/herself in a manner that would contravene the law or act against the public order or good morals in regard to the accommodation;
(4) When the Guest seeking accommodation can be clearly detected as carrying an infectious disease;
(5) When the accommodation is requested to assume an unreasonable burden in regard to his/her accommodation;
(6) When the accommodation is unable to provide accommodation due to natural calamities, malfunction of the facilities and/or other unavoidable causes; or
(7) When the Guests seeking accommodation are:
01 Deemed to be a designated organized crime group, a designated organized crime group member, a corporate racketeer, an extremist, or any other person deemed liable to exhibit antisocial behavior (hereinafter collectively referred to as "organized crime groups"), or a related person of an organized crime group;
02 Deemed to be a corporation or other entity whose business activities are controlled by an organized crime group or a member of an organized crime group;
03 Deemed to be a corporation whose directors (equivalent to an executive officer) include persons corresponding to a member of an organized crime group;
04 Deemed to be a person who allows an organized crime group etc. to utilize its name;
05 When behaving in a manner that makes trouble for other Guests of this accommodation;
06 When violent demands and/or actions are made or carried out, or burdens that exceed the scope of reasonable requests have been made, to the accommodation or our staff.

Right to Cancel Accommodation Contracts by the Guest
Article 6.
1.The Guest is entitled to cancel the Accommodation Contract by so notifying the Accommodation.
2.In the case where the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable, the Guest shall pay cancellation charges as listed in the Appendix 2 (except in the case where the Hotel has requested the payment of the deposit during the specified period as prescribed in Article 3.2 and the Guest has cancelled before the payment). However, in the case where a special contract as prescribed in Article 4.1 has been concluded, the same shall apply only when the Guest is informed of the obligation of the payment of the cancellation charges in case of cancellation by the Guest.
3.In the case where the Guest does not appear by 8 p.m. on the accommodation date (2 hours after the expected time of arrival if the Accommodation is notified of it) without an advance notice, our Accommodation may regard the Accommodation Contract as being cancelled by the Guest.

Right to Cancel Contracts by Accommodation
Article 7.
1.Our Accommodation may cancel the Accommodation Contract under any of the following cases:
1) When the Guest is deemed liable to conduct or has conducted him/herself in a manner that would contravene the laws or act against the public order and good morals in regard to the accommodation;
2) When the Guest can be clearly detected as carrying an infectious disease;
3) When Accommodation is requested to assume an unreasonable burden in regard to his/her accommodation;
4) When Accommodation is unable to provide accommodation due to natural calamities and/or other causes of force majeure;
5) When the Guest does not observe the rules prohibiting certain actions specified under the Accommodation Regulation stipulated by the Accommodation (restricted to prohibitions deemed necessary in order to prevent fires), such as smoking in bed, and causing mischief to the fire fighting facilities;
6) When the Guest does not observe the rules prohibiting certain actions specified under the House Regulation stipulated by the Accommodation;
7) When the Guests seeking accommodation are:
① Deemed to be a designated organized crime group, a designated organized crime group member, a corporate racketeer, an extremist, or any other person deemed liable to exhibit antisocial behavior (hereinafter collectively referred to as "organized crime group"), or a related person of an organized crime group;
② Deemed to be a corporation or other entity whose business activities are controlled by an organized crime group or a member of an organized crime group;
③ Deemed to be a corporation whose directors (equivalent to an executive officer) include persons corresponding to a member of an organized crime group;
④ Deemed to be a person who allows an organized crime group etc. to utilize its name;
⑤When behaving in a manner that makes trouble for other Guests of this Accommodation;
⑥ When violent demands and/or action are made or carried out, or burdens that exceed the scope of reasonable requests have been made, to the Accommodation or our staff.
2.In the case where the Accommodation has cancelled the Accommodation Contract in accordance with the preceding Items, the Accommodation shall not be entitled to charge the Guest for any services which he/she has not received.

Registration
Article 8.
1.The Guest shall register the following particulars at the front desk of our Accommodation on the day of accommodation;
(1) Name, age, sex, address and occupation;
(2) Except in the case of a Japanese national, nationality, passport number, and port and date of entry into Japan;
(3) Date and estimated time of departure
(4) Other particulars deemed necessary by the Accommodation.
2.In the case where the Guest intends to pay his/her Accommodation Charges prescribed in Article 12 by any means other than cash in Japanese currency, such as traveler's cheques, coupons or credit cards, such means of payment shall be shown in advance at the time of the registration prescribed in the preceding Items.

Occupancy Hours of Guest Rooms
Article 9.
1.The Guest is entitled to occupy the contracted guest room of the Accommodation from 2 p.m. until 11 a.m. on the day of departure. However, when the Guest is accommodated for a continuous number of days, the Guest may occupy the room for the entire day, except for the days of arrival and departure.
2.The Accommodation may, notwithstanding the provisions prescribed in the preceding Item, permit the Guest to occupy the room beyond the time prescribed in the preceding Item. In that case, extra charges shall be paid as follows:
(1) Up to 3 hours: 30% of the room charge
(2) Up to 6 hours: 50% of the room charge
(3) More than 6 hours: The room charge in full

Observance of Accommodation Regulation
Article 10.
1.The Guest shall observe the Accommodation Regulation established by the Accommodation, which are posted within the premises of the Accommodation.

Business Hours
Article 11.
1.The business hours of the main facilities, etc. of the Hotel are as follows:
(1) Curfew-------------------------------------------Nil
(2) Front Desk service---------------------------24 hours
2.In the case where there are necessary and unavoidable circumstances, the business hours as stated in the preceding Item may be changed temporarily. The changed time will be notified in an appropriate way by the Accommodation.

Payment of Accommodation Charges
Article 12.
1.The breakdown and the calculation method of the Accommodation Charges, etc. that the Guest shall pay are listed in Appendix 1.
2.Accommodation Charges, etc. as stated in the preceding Item shall paid at the Front Desk at the time of the Guest's departure or upon request by the Accommodation, in Japanese currency, or by such other means as shall be acceptable to the Hotel such as traveler's cheques, coupons or credit card. Accommodation Charges shall be paid even if the Guest does not utilize the accommodation facilities once such facilities have been made available to him/her by the Accommodation.

Liabilities of the Accommodation
Article13.
1.The Accommodation shall compensate the Guest for the damage if the Accommodation has caused such damage to the Guest in the fulfillment or the nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in the case where such damage has been caused due to reasons for which the Accommodation is not liable.

Handling when Unable to Provide Contracted Room
Article 14.
1.The Accommodation shall arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest when unable to provide contracted room(s).
2.When an arrangement of other accommodation cannot be made, notwithstanding the provisions of the preceding Item, the Accommodation shall pay the guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to the reparations. However, the Accommodation will not pay the compensation fee to the Guest when the Accommodation cannot provide accommodation due to causes for which the Accommodation is not liable.

Handling of Deposited Articles
Article 15.
1.The Accommodation shall compensate the Guest for damage to articles, money or valuables the Guest has deposited at the Front Desk when said articles, money or valuables have been lost, broken or suffered other damage, except when the result of force majeure. However, when the Accommodation had asked the type and value of such items and they had not been reported in advance by the Guest, the Accommodation shall compensate the Guest for the loss of money or valuables up to a maximum of \150,000, except in cases where loss or damage was caused intentionally or by gross negligence on the part of the Accommodation.
2.The Accommodation shall compensate the Guest for damages to articles, money and valuables the Guest has brought into the Accommodation and has not deposited at the Front Desk, when damage including loss or breakage was caused intentionally or by gross negligence on the part of the Accommodation. However, when the type and value of such items has not been reported in advance by the Guest, the Accommodation shall compensate the Guest for the loss up to the maximum of \150,000, except in cases where loss or damage was caused intentionally or by gross negligence on the part of the Accommodation.

Custody of Baggage and/or Belongings of the Guest
Article 16.
1.When the baggage of the Guest is brought into the Accommodation before his/her arrival, Accommodation shall be liable to keep it and to hand it over to the Guest at the Front Desk at the time of his/her check-in only if the Accommodation has agreed to do so in advance.
2.The Accommodation's liability in regard to the custody of the Guest's baggage and belongings in the case of the preceding two Items shall be assumed in accordance with the provisions of Item 15.1, in the case of 16.1, and with the provisions of 15.2, in the case of 16.2.
3.The Accommodation's liability in regard to the custody of the Guest's baggage and belongings in the case of the preceding two Items shall be assumed in accordance with the provisions of Item 15.1, in the case of 16.1, and with the provisions of 15.2, in the case of 16.2.

Liability of the Guest
Article 17.
1.The Guest shall compensate the Accommodation for any damage caused through intention or negligence on the part of the Guest.

Disclaimer
Article 18.
The Guest shall utilize the internet communication that entails his/her liability. In the case where the internet communication is interrupted by a system failure or the other reasons, the Accommodation will not bear the liability for any damage to the Guest. Also, the Guest shall compensate the Accommodation or a third party for any damage caused through the act of an internet communication judged unapt by the Accommodation.

Remarks:
1.Basic Accommodation Charge is indicated as a tariff at the Front Desk and in the guest room.
2.Children shall be charged the same accommodation charges as adults, except a child under school age, in which case we need not offer a bed and meal.
3.In the case where the tax law has been revised, the revised tax law shall be admitted.

Appendix 2: Cancellation and Charges (Ref. Article 6.2)

Remarks:
1.The percentages signify the rate of the cancellation charge for the Basic Accommodation Charges.
2.When the number of days contracted is shortened, cancellation charges for its first day shall be paid by the Guest regardless of the number of days shortened.
3.When part of a group booking (15 persons or more) is canceled, no cancelling charges shall apply if the number of people cancelling is less than 10% of the total number of people booked, with fractions rounded up to the next whole number.
